Datpro Ltd commenced in 2001 with formation as a limited company being made in 2002 by Bernie Brooks and myself, Barrie Goehler, each of us were managing directors of separate security companies at the time.
The company was formed, primarily, as a consequence of us being unable to obtain specific advice on Data Protection issues regarding CCTV and our not being able to purchase, at a reasonable, or indeed in some cases, at any price, the equipment that was needed to ensure compliance with the Data Protection Act for the CCTV systems our own respective companies were advising, designing and installing for clients.
When we looked at the Act in detail and studied the Code of Practice issued in July 2000, by the then Data Protection Commissioner Elizabeth France, we were staggered to find that even this relatively simple code, compiled to assist operators of CCTV systems contained, dependant on interpretation, some seventy legally enforceable points of law and numerous issues of good practice.
Further more we noted that even for people regarded as ‘experts’ in their respective fields, understanding the Act and individualising the requirements of the Code of Practice to each separate CCTV installation was an almost impossible task.
There is of course no legal obligation in the act which requires an installing company to design or install a CCTV system which is compliant. The responsibility is clearly that of the client, the Data Controller.
We could have taken the easy route, many other companies did and still do, of using a disclaimer similar to “you are advised that it is illegal to operate a CCTV system that does not meet the requirements of the Data Protection Act, further information is available on your obligations as Data Controllers on the Information Commission’s own government website”
Datpro Ltd chose a different route. We enlisted the help of a qualified solicitor and the journey to building, what was to become the first and now THE leading specialist company on the Data Protection Act as it relates to CCTV had begun.
It wasn’t long before a number of the leading UK suppliers of CCTV equipment learnt about the expertise we at Datpro Ltd had gathered and enlisted our services.
Datpro Ltd, since starting in business and as our reputation grew, has expanded its customer base to include ‘end users’. Datpro Ltd now advise a wide range of clients including local authority bodies, the police and many blue chip companies, both on achieving compliance with the Act at the installation stage and on maintaining compliance on an on-going basis with the ever changing legal requirements.
Failure to operate a CCTV system in full compliance with the Data Protection Act can have far reaching consequences
The Data Controller can be fined up to £5,000 and recordings which don’t meet the standards laid down by the Act may not be able to be used for evidential purposes in a court of law. If you are responsible for operating a CCTV system, even if you don’t actually own the system, you should be aware that, to quote the Act;
“Any director, manager, secretary or officer of a company or corporation or someone purporting to act in any such capacity is personally guilty of the offence in addition to the corporate body if;
- The offence was committed with his/her connivance; or
- The offence was attributable to any neglect on his/her part”
In other words, “ignorance is no excuse” and even if you’re just “doing what I’m told to do” you can still be held to account.
